District Public Prosecutor’s Office

Competence of District Public Prosecutor’s Offices corresponds in material aspects to the comeptence of District Courts. District Public Prosecutor’s Offices are attached to District Courts, unless a special Act stipulates otherwise. In the district of the capital city of Praha the competence of District Public Prosecutor’s Offices is exercised by District Public Prosecutor’s Offices in individual city districts and in the city Of Brno the competence of District Public Prosecutor’s Office is exercised by the Municipal Public Prosecutor’s Office in Brno. Public prosecutors of these Public Prosecutor’s Offices represent public prosecution in proceedings held before District Courts as courts of first instance.

Regional Public Prosecutor’s Office

Competence of Regional Public Prosecutor’s Offices corresponds in material aspects to the comeptence of Regional Courts. Regional Public Prosecutor’s Offices are attached to Regional Courts, unless stipulated otherwise. In the district of the capital city of Prague the competence of Regional Public Prosecutor’s Office is exercised by the Metropolitan Public Prosecutor’s Office in Prague. Public prosecutors of these Public Prosecutor’s Offices represent public prosecution in proceedings held before Regional Courts as courts of first instance or second instance, if they decide on appeals and complaints against decisions of District Courts. Furthermore, Regional Public Prosecutor’s Offices function as the basic link when handling incentives for filing complaints against the breach of law in criminal cases and when reviewing criminal cases on their own initiative. Regional Public Prosecutor’s Offices exercise supervision over the operation of District Public Prosecutor’ Offices.

High Public Prosecutor’s Office

Competence of High Public Prosecutor’s Offices corresponds in material aspects to the comeptence of High Courts. The seat of the High Court in Praha is the capital city of Praha and the seat of the High Court in Olomouc is the city of Olomouc. The High Public Prosecutor’s Office is active in proceedings on regular remedial measures against decisions made by Regional Courts as courts of the first instance. The High Public Prosecutor’s Office is also involved in handling incentives for filing complaints against the breach of law in criminal cases and in reviewing these cases on their own initiative.  The High Public Prosecutor’s Offices exercise supervision over the operation of Regional Public Prosecutor’s Offices. There are specialized departments for prosecution of serious economic and financial crime at High Public Proseutor’s Offices.

Prosecutor General’s Office

Competence of the Prosecutor General’s Office is in concordance with the competence of the Supreme Court. The Prosecutor General’s Office also exercises supervision over the operation of High Public Prosecutor’s Offices, moreover it is involved in handling incentives for filing complaints against the breach of law in criminal cases and in reviewing these cases on its own initiative. The Prosecutor General’s Office also issues explanatory opinions, which are in the form of recommendations and deal with specific problems of aplication of law, which the Public Prosecutor’s Office encounters in practice, both in criminal and non-criminal area.

The Prosecutor General’s Office issues decisions and opinions regarding the interpretation of laws and other legal enactments, which are published in the Collection of Judicial Decisions and Opinions, or in cases, where a certain legal issue requires unification of interpretation or if there were varying decisions of courts of lower instances, also in matters related to several divisions of the Supreme Court or maters disputable between individual divisions; furthermore it participates in proceedings on the recognition and execution of decisions of foreign courts in the territory of the Czech Republic, if the law or an international treaty requires it. The Prosecutor General’s Office is represented in Eurojust and is a member of the Network of Prosecutors General of Member States of the European Union.
